It is shocking that Harsimrat Kaur Badal was busy having forty winks, when the draft of Inter-State River Water Disputes (Amendment) Bill 2019 was being approved by the Modi cabinet, having far reaching consequences for Punjab . Intriguingly, both the Ministers in Ministry of Jal Shakti belongs to the States, with whom the Punjab is having serious River Water sharing disputes. Mr. Gajendra Singh Shekhawat Cabinet Minister in Ministry of Jal Shakti is from Rajasthan whereas the   Minister of State Mr. Rattan Lal Kataria  in the same ministry is from Haryana.

Although  the objectivity of the legislation is supposed to quicken the pace of resolving the  long pending river water disputes between the States; but the  sudden insalubrious development stoke up grave fear  of  injustice for Punjab,   if  the final  adjudication of inter-state River Water dispute  is done by applying a centralized mechanism as envisaged by the amended legislation. Section 14 of the Principal Act has been introduced in a clandestine manner without taking in to confidence the State of Punjab. Surprisingly, Section 14 of the Principal Act entails;

"14. The Ravi and Beas Water Tribunal constituted prior to the date of commencement of the Inter-State River Water Disputes (Amendment) Act 2019 shall stand dissolved and the water disputes pending adjudication before it shall stand transferred to the Tribunal”

The appointments of the Chairman, Vice Chairman and members of the Tribunal would lie in centralized domain of the central Government instead of the Chief Justice of the Supreme Court of India as per the earlier arrangement. I wonder why the Central Government has usurped the powers of the Chief Justice of the Supreme Court of India in this piece of legislation. It smacks brazen arbitrariness, with which the Government of India is monopolizing even the judicial powers, in order to adjudicate the tricky and ultra sensitive issue of river water dispute between Punjab and Haryana. The hush-hush manner in which the Modi Government has scrapped Article 370 and 35-A of the Indian Constitution and stripped off Jammu & Kashmir of its Statehood, has aroused cynical speculation that Punjab could be treated with a similar arbitrary yard stick if do not surrender its river water interests and refuse to fall in line as per the dictates of the BJP. It is atrocious that the award pronounced by the Tribunal constituted under the arrangements of Inter-State River Water Disputes (Amendment) Act 2019 cannot be challenged in the Supreme Court at first place .

I am appalled to notice that none out of thirteen Members of Parliament (Lok Sabha) from Punjab, and ironically one of them Mrs. Harsimrat Kaur Badal being Cabinet Minister, including Sukhbir Singh Badal cared to object the draconian clauses of the said legislation, when the aforesaid Bill was introduced in the Lok Sabha and passed by the voice vote. River water sharing dispute continue to be  a core issue for the multi-dimensional future of the agrarian State of Punjab but the kind of blatant callousness shown by Punjab MPs in this case speaks volumes of their lack of concern towards the State they represent in Parliament . Thus all the four parties representing Punjab in the Lok Sabha, owes public explanation to the people of Punjab as to why they were slumbering when such an important legislation was tabled on the floor of the house (Lok Sabha)  and the interests of Punjab were being bartered away by the BJP in Parliament.

I am afraid that the Central Government may unleash similar terror by deploying security forces and the Indian Army in a strength that could be much beyond our imagination, in case there is vociferous post award reaction in Punjab and squabbling between the States.

The Shiromani Akali Dal (Taksali) demand the change of portfolios of both the incumbent Ministers in the Ministry of Jal Shakti because they will influence the process of adjudication and the proceedings of the Tribunal harming the vital interests of Punjab and thus  favoring their own States.  SAD (Taksali) vehemently oppose the legislation and also condemn the  despicable manner in which the draconian clause referring to Ravi and Beas  water sharing dispute was  arbitrarily and surreptitiously introduced in Parliament.

Chandigarh, August 12: It was a poignant moment for the Kashmiri students in Punjab. They had expected to be celebrating Eid-ul-Adha alone this year, since they could not go to their families in the Valley due to the prevailing situation, but were in for a pleasant surprise.  The invitation from Punjab Chief Minister Captain Amarinder Singh for lunch at Punjab Bhavan made it an occasion to cherish, and to feel at home.

Around 125 students from various universities of Punjab had a taste of the love that the Chief Minister, along with several of his cabinet colleagues, decided to shower on them to mark their auspicious festival.

Assuring them that he was confident things would improve soon in Kashmir, the Chief Minister greeted the youngsters with best wishes for normalcy soon. "We cannot replace your families but I hope you consider us as your family too,” he told the students, assuring them of their safety and security in Punjab.

Though he had not been to Kashmir for a long time due to his busy political schedule, he considered the beautiful Valley his second home, said Captain Amarinder, adding, it was his heartfelt desire to share the happiness of this festival with the students. He reassured the that he was confident their families back home would also be well and safe, and they would be able to meet soon.

Reciprocating the Chief Minister’s sentiments, the students said they too considered Punjab their second home, where they had always felt safe, even after the Pulwama attack. "We have seen that Punjabis have a big heart,” quipped a student, Faiq Salem, while another thanked Captain Amarinder for hearing their voice.

"Coming here today reminds us of our families,” said Farzana Hafeez, another student, admitting that till they received the invitation, they had been feeling very lonely at the thought of not being home for Eid.

As a memento of their love and respect, the students presented to the Chief Minister a portrait sketched by Abdul Azad, a Fine Arts Kashmiri student from Chandigarh University. Captain Amarinder gave sweets to the students to celebrate the occasion.
 
Cabinet Ministers Brahm Mohindra and Balbir Singh Sidhu were also present during the interaction.

India is watching today the most discernible model of Cooperative federalism of Mr. Narinder Modi. What has happened to the State of Jammu & Kashmir today is the culmination of the sinister designs of RSS and BJP? The only Muslim majority State in India loses its special constitutional status today guaranteed under Article 370 of the Indian constitution. Not only this; the full fledged State of Jammu & Kashmir has been reduced to a Union territory which would be governed directly by the Ministry of Home affairs Govt. of India.
 
Thanks to the new ugly face of aggressive majoritarianism the ugly development is bound to have far reaching catastrophic implications for times to come. The well calibrated communal agenda of the BJP has come to the play in order to thwart the strength of the minorities in India. The collective sensitivity of the religious minorities in India has suffered a rude shock.
 
Constitutional guarantees given to the States or communities just cannot be abrogated, reversed or altered in this kind of arbitrary manner unilaterally. History is repeating itself. It is the same catastrophic breach of trust that was meted out to the Sikh Community by the Congress leadership after partition. Congress leadership betrayed and suppressed all the rightful aspirations of the Sikh Community, soon after India became free despite their solemn commitments given to the Sikh Leadership.

Most unfortunately SAD (Badal) by supporting the scrapping of article 370 of the Indian Constitution has treacherously betrayed the spirit of the entire Sikh struggle by turning their back to the fundamental provisions of the Anandpur Sahib Resolution, which envisage greater autonomy for Punjab. I wish to warn the people of Punjab that same thing is going to happen with Punjab on the issue of river water sharing and Punjab could be the next union territory in the future scheme of things of the BJP and RSS combine.

Amid apprehension of an adverse reaction from Pakistan to the developments in Kashmir, Punjab Chief Minister Captain Amarinder Singh on Monday prohibited any kind of celebrations or protest that could vitiate the atmosphere in the state.

With tension escalating at the border, the Chief Minister directed the Punjab Police to be prepared to thwart any attempts by Pakistan to create disturbance in the state. 

The Chief Minister was reviewing the law and order situation in the state in the wake of the revocation of Article 370 in Kashmir. Top police and civil brass attended the review meeting, which took note of the volatile situation post the Central Government’s announcement on Kashmir.

Pakistan may not take this lightly and could resort to some act against India, the Chief Minister warned, asking the state police to be ready for any eventuality. Captain Amarinder has ordered increased security for the 8000-odd Kashmiri students in Punjab, and directed SPs and DCs to meet them and talk to them personally.

The Chief Minister, who is personally monitoring the situation, has ordered scaling up of security in Punjab’s districts that border Kashmir. He reiterated his earlier directions to the police and the district administration to ensure smooth and safe movement of those leaving Kashmir via Punjab. The border areas of the state have been on heightened alert for the past two days, since tourists and Amarnath Yatris were asked to leave the Valley, citing security concerns.

Captain Amarinder has, meanwhile, appealed to all, within and outside Kashmir, to remain calm and not do anything to disturb the peace and harmony of the nation in these difficult circumstances.

The meeting was attended, among others by CPSCM, Suresh Kumar, Chief Secretary, Karan Avtar Singh, DG Punjab Police, Dinkar Gupta, Home Secretary, Satish Chandra, DGP (Intelligence), VK Bhawra and PSCM, Tejveer Singh.

Sukhpal Singh Khaira Bholath MLA and president of Punjab Ekta Party(PEP) today  questioned  Punjab Chief Minister   for playing dubious role in cases of sacrilege of Guru Granth Sahib and asking CBI to reopen the cases .

Khaira asked the CM how he failed to implement the resolution passed by Vidhan Sabha to take back the cases from CBI? On one hand he advocated to probe the cases by SIT of Punjab police and on the other hand he is asking for CBI to reopen the cases. He added that Capt Amarinder Singh was hobnobbing with SAD and BJP to give clean chit to Dera Sacha Sauda followers, named in the sacrilege cases.

Khaira said that Sukhbir Badal was also doing same flip flop on the issue of sacrilege and changing stand. He first rejected the closure report by CBI and in second instance he tried to justify CBI report and holding Dera followers innocent. Sukhbir Badal claimed the findings of Punjab Police were wrong without realizing that SIT led by Ranbir Singh Khatra was set up by his own government. Even Zora Singh Commission set up by Badal government hinted at involvement of Dera followers and Badal buried the report under carpet.

Khaira alleged that by clubbing the statements of Sukhbir Badal and Capt Amarinder Singh, even a layman can understand their game plan to confuse people and jeopardize the probe into sacrilege cases. He said that rejecting the CBI closure report and asking CBI to reopen the cases was another fraud with the Sikh community. He said that it could be ploy to shut down parallel probe by SIT led by Kunwar Vijay Partap Singh in sacrilege cases and Police firing at Behbal Kalan.

Khaira said that  resolution passed in the Vidhan Sabha was an eyewash and an attempt to seek false sympathy of Sikhs and sabotage the Bargari Morcha. He asked Capt Amarinder Singh to make public any official communication with center for withdrawal of CBI cases.  If any communication was ever sent why it was not implemented by center, he asked.

He said that Punjab government had not even attached the Vidhan Sabha resolution with its application filed in the Mohali CBI court to seek copy of closure report which shows real intentions of Congress government.  He said that due to assembly elections in Haryana, the SAD, BJP and Congress wanted to bury the sacrilege cases with an eye on Dera votes.  Now it is for the Sikh community to identify their real enemies.
