The State Information Commission slapped a penalty of Rs. 25,000 on Mr. Charanjit Singh, Executive Officer O/o Nagar Council, Khanna for causing inordinate delay in providing the information to the applicant under the RTI Act, 2005.
Disclosing this official spokesperson of the State Information Commission said that the penalty was imposed by the single bench of S.S. Channy, Chief information Commissioner, Punjab. Narrating the facts of the case the spokesperson said that Ghanwinder Singh, S/o Balvir Singh vide application dated January 22, 2015 addressed to PIO , O/o Executive Officer Nagar Council, Khanna sought information regarding the payment made to the contractor Rupesh Rupa for the work of concretization of streets and drains form January 1, 2012 to till date. The certified copy of the tender passed to construct street number 9, Krishna Nagar, Ward number 19 was also sought.
Failing to get any information within 30 days as mandated under Section 7(1) of the RTI Act, 2005, the appellant had filed first appeal with the State Commission.
Chief Information Commissioner in his order has stated that "From the material available on record, it has been established that there has been unnecessarily delay in conveying the right kind of information and inform the information seeker about the correct state of affairs on the issues raised by the complainant in regard to his request for information. No explanation for delay has been given by Mr. Charanjit Singh, Executive Officer him. Rather, his failure to even response to the show cause direction by the Commission reinforces the fact that he has been without any reasonable cause, guilty of remissness in the discharge of his duties. He is, therefore, deserves to be penalized.
In the final order Chief Information Commissioner further said that "As the delay is of more than one year, I impose a penalty of Rs. 25000/- upon Sh. Charanjit Singh, Executive Officer o/o Nagar Council, Khanna, District, Ludhiana. The amount of penalty i.e. Rs. 25000/- should be deducted from his salary in two equal monthly installments for the month of October and November and be deposited in the treasury under the relevant head.
