Why celebrate Republic Day when Cheer Haran has been done to our Constitution?

January 26 is celebrated as Republic Day in India, but I have renamed it Cheer Haran (disrobing) Day. The truth is that the Constitution promulgated in 1950 has been flagrantly flouted and torn to shreds and has been rendered a scarecrow, hollow and empty, and now only acting as an instrument to deceive the gullible people by our politicians, who are almost all thugs, gundas, rogues, rascals, deceivers, looters, scamsters, and experts in polarizing the people by spreading caste and communal hatred to get votes, only interested in power and pelf, but having no genuine love for the people.

Consider the facts:

1. The Constitution 'guaranteed' equality among the people vide Articles 14 to 18, which were proclaimed as fundamental rights. Also, Article 38(2) stated, "The state shall strive to minimise inequalities in income". Article 39(c) stated that the state shall direct its policy to ensure that there is no concentration of wealth.

But what is the reality today? It is reported that 7 Indians own wealth equal to the wealth of the bottom 50% of the 135 crore Indian people who are abysmally poor.

Muslims, dalits and women are often discriminated against

So much for equality!

2. Article 21 'guaranteed' liberty. But sedition and preventive detention laws make a mockery of it, as exemplified by the arrest and detention of Kashmiri politicians like the 82 year old Farooq Abdullah and others for the last about 6 months, fabricated cases of the Bhima-Koregaon accused, arrest and dismissal on flimsy charges of the the brave police officer Sanjiv Bhat who dared to give an affidavit in the Supreme Court implicating Modi in the massacre of Muslims in 2002, etc. Even a satirical tweet can result in deprivation of liberty, as illustrated by the case of Abhijit Iyer Mitra, whose bail application was rejected by the Supreme Court, the much flaunted 'custodians of the rights of the people' with the flippant and cruel remark by that sexual pervert CJI Ranjan Gogoi "You are safest in jail".

Although in Romesh Thapar vs State of Madras—a judgement given by the Supreme Court a few months after the promulgation of the Constitution in 1950—it was held that in a democracy people had the right to criticise the government, it is often dangerous to do so. In West Bengal, the Jadavpur University Professor Ambikesh Mahapatra was arrested for circulating cartoons of Chief Minister Mamata Banerjee, and a farmer, Silanath Choudhary, was arrested for telling Banerjee in a public rally that she had not kept her election promises. The Manipur journalist Kishorechand Wangkhem was arrested for criticizing the CM Biren Singh.

In Tamil Nadu, the folk singer Kovan was arrested for singing a song criticising the then chief minister Jayalalithaa for profiting from state-run liquor shops. In Maharashtra, the cartoonist Aseem Trivedi was arrested on sedition charges for making a cartoon depicting politicians as corrupt.

So much for liberty!

3. The Preamble to our Constitution calls India a secular republic, and Article 25 'guarantees' freedom of religion. But that did not prevent lynching and attacks on Muslims by gau rakshaks, prosecution of Muslims on false charges, hate speeches against them and their victimization, and vandalism against churches in Delhi or persecution of Christians in Odisha.

So much for our secularism!

4. Article 39(f) directs the state to ensure that children develop in a healthy manner, and Article 47 directs it to raise the level of nutrition. And yet over 70 years after independence, 48 per cent of Indian children are malnourished, and the situation has grown worse under Modi’s rule.We have the distinction of having over one-third of the world's malnourished children (see data given by Global Hunger Index). In this respect, we are worse than sub-Saharan countries like Somalia.

5. Article 39A states that the state shall ensure that the legal system promotes justice. But with 33 million pending cases and cases often taking decades to decide, and a large section of the judiciary having become corrupt,  is justice not a joke in India

6. Article 41 states "The state shall make effective provision for securing the right to work and education, and public assistance in cases of unemployment, old age and sickness."

The right to work can only be ensured when there is rapid industrialization and the economy is growing, creating millions of jobs. But recently the Indian economy is tanking, GDP is slipping, manufacturing sector ( e.g, auto sector ) is nose diving, IT sector, real estate sector etc in the dumps, with sales down and massive lay offs. At the same time prices of foodstuffs, fuel etc have soared.

But our state is in the hands of our crooked netas who have no inkling how to resolve the crisis, but are only interested in power and pelf, and care two hoots for this provision (probably very few would even know of its existence). They can only resort to gimmicks like building Ram temple, cow protection, Yoga Day, Swatchata Abhiyan (cleanliness drive), abolition of Article 370, CAA, etc, and of course bashing our scapegoats, the Muslims, as Jews were bashed in Nazi Germany, to divert attention from the real problems.

Prime Minister Narendra Modi, in his 2014 election campaign, promised creation of 2 crore jobs annually if BJP came to power. But it is estimated demonetisation alone destroyed 2 crore jobs, and unemployment is mounting to record heights in India, as admitted by National Sample Survey, a Govt of India organisation.12 million youth are entering the Indian job market every year, but the number of jobs is declining. Many of these youth will end up as criminals, beggars or suicides.

As for good education, it is available only to a few in India, and most schools are in an abysmal condition.

The same can be said of the state of public health in India, despite Article 47. For the rich and mighty, there are state-of-the-art hospitals, but for the masses, there is little.

7. Article 43 states that the state shall endeavour to secure a living wage to workers, industrial or agricultural. But with the massive level of unemployment in India, and the contract system largely replacing security in employment, a worker dare not ask a wage higher than whatever pittance he gets, lest he lose his job. And as for agriculture, this provision is a cruel joke on the over 300,000 farmers who committed suicide in India.

8. Article 48A directs the state to protect and improve the environment, but the pollution levels in most Indian cities (even the capital Delhi) have reached record heights, and our rivers are badly polluted.

9. Article 51A(h) states that it is the duty of all citizens to promote the scientific temper. But we have a Prime Minister who said that the fact that Lord Ganesh had the head of an elephant shows that ancient Indians knew head transplant surgery and genetic engineering. We have a Governor (of West Bengal) who said that Arjun had arrows with nuclear power and ancient India had flying chariots. Last year in the Indian Science Congress some ‘scientists’ made claims that the Kauravas were born by stem cell and test tube technology, and there were guided missiles, aircraft and airports in ancient India.

10. Citizenship will be denied to Bangladeshi Muslims who have been living in Assam for decades, though it will be granted to Bangladeshi Hindus by the Citizenship Amendment Act

So what is there to celebrate about? Cheer haran has been done to our Constitution, and there seems to be no Lord Krishna to save the country's honour

WE THE PEOPLE
Is India truly a secular country?
18.01.20 - Markandey Katju
Is India truly a secular country?

The preamble to the Indian Constitution declares India to be a secular country, and Articles 25 to 30 are also that effect.

But what is the truth? The truth is that the Constitution is only a piece of paper, and the ground reality is that India is a highly communal country. Most Hindus in it (and 80% of its population is Hindu) are communal, and so are most  Muslims (who are 15-16% of the population). Why is it so ? This needs a deeper analysis which is given below.

Secularism is a feature of industrial society (as exist in North America, Europe, Japan, etc ). It is not a feature of feudal or semi feudal society. In India the feudal economy was partially destroyed after Independence by the zamindari abolition laws, a certain limited degree of industrialization etc. However, the feudal mindset still continues among most of our people, as is obvious from the rampant casteism and communalism, which are feudal forces, and are still widespread in our society. Hence India can still be called a semi feudal country.

Why is secularism a feature of industrial society, but not of feudal or semi feudal society?

The reason is that feudal society is an agricultural society in which human groupings are small, and scattered over large rural areas. In contrast, in industrial society human groupings are large, and concentrated in factories, offices, etc in cities to which the peasants have migrated.

When people of different religions come together (in factories, offices etc) and interact they realize that persons of other religions are not the devils which they had been depicted to be, rather they share the same objectives of getting higher wages, better working conditions, etc. This changes their mindsets, and makes them secular ( when earlier they were communal ) and unites them in the common struggle for attaining their objectives.

In India the policy of the British rulers was to keep India broadly feudal and unindustrialised. They permitted setting up some light industries like textile mills, plantations etc, but not heavy industry like steel mills. After Independence in 1947 no doubt a limited degree of industrialization took place (e.g. some steel mills were set up, engineering colleges were established etc), but this was not a full fledged industrialization as took place in Western countries, Japan, and later China. Consequently, India still remains a semi feudal country, and hence its people are still largely communal.

When a Muslim is lynched by cow vigilantes most Hindus are indifferent, and some even happy. One fanatic, terrorist or anti national less ! After 2014 religious polarization has increased in India (and even among NRIs abroad, e.g, in the Bay Area of California where I am presently staying).

In the ongoing anti CAA agitation my impression is that the majority of protesters are Muslims, but for that very reason most Hindus are not. The Hindus who are supporting the agitation are a minority of Hindus, maybe 10% of them (the so called ‘liberals’ and University students in big cities like Delhi, Kolkata and Mumbai). Hence although I am personally against the CAA (see my article ‘Why the Citizens Amendment Act is unconstitutional‘) I fear that the anti CAA agitation is further polarizing Indian society and benefiting the BJP, as it is further consolidating most Hindus behind it.

In my opinion India will only become a secular country when it is highly industrialised, but that is possible only after a mighty historical united people’s struggle led by genuinely patriotic and modern minded leaders creates a new political and social order in which society and the economy are organized on scientific lines, and there is rapid industrialization. Until that happens, communalism will continue, and Indian society will remain polarised on religious and caste lines.

BAS KARO AB 'MANN KI BAAT'
The monologue must end
15.01.20 - VIPIN PUBBY
The monologue must end

SPEAKING AT THE 50th anniversary of South India’s Tughlak magazine this week, Prime minister Narendra Modi said that he believed that there are two essential reasons "that our great civilisation has prospered. The first is India’s celebration of harmony, diversity and brotherhood. The second reason is the will and zeal of India’s people. Whenever the people of India decided to do something, no force has been able to stop them.”

Good and wise words certainly. He also went on to the say that "as India enters a new decade, it is the very people of India, who will guide India’s growth trajectory and take it to new heights”. He said he always "bowed to the people of India who have, time and again, upheld the constitution in letter and in spirit”.

These words coming from Modi, who specialises in one-sided dialogue whether it is through election speeches, public rallies, Parliamentary speeches and his Mann Ki Baat, are most welcome but the Pradhan Sewak must also reach out to the people of the country through meetings and dialogues.

It must also be pointed out that he and his government had been talking to various nations on issues of international interest. He had been himself travelling extensively to engage in dialogue with foreign dignitaries and his government has most recently called for a dialogue on preventing an escalation of conflict between America and Iran.

Yet when it comes to the contentious issues within the country, he and his government are not willing to reach out and talk to the people agitating for long or wanting their voice to be heard.

The other day a news channel was interviewing women who have blocked a particular road and have been sitting on a round the clock dharna for the last few weeks in the national capital to demand withdrawal of Citizenship Amendment Act and the National Register of Citizens.

These are hundreds of women, some with small children and some over the age of 80 years, who had no political affiliations. They were saying that no one from the government or the ruling party had turned up to hear them and that they were willing to lift the dharna only if someone senior could come and listen to them.

Similarly hundreds of protests are taking place in the country which are not being reported by the media for reasons beset known to it but the government has made no effort to reach out to them for a dialogue.

The debates on new television channels have become a farce. No body listens to or tries to understand the point of view of the other. Their responses are predictable and mostly on party lines.

Interestingly some of these panelists with well known party affiliations have started masquerading themselves as "political analysts” but viewers know better. There is just no effort to enter into a dialogue or to yield even an inch to the other side.

Such ‘debates’ are getting more shriller and irrelevant. No wonder most people have stopped watching these news channels. Those who still have the stomach to watch the anchors humiliating the guests or the panelists indulging in harsh and acerbic talk over each other. Hard news for which people want to watch TV is unfortunately is totally missing and people have to turn to digital media to find out what’s happening.

Over 100 retired very senior officers, each with a distinguished record of service to the nation, have formed a group called "Constitutional Conduct Group” which speak out on public issues. In a recent letter to the prime minister, the group has said that the citizens are fearful of some of the decisions taken in the recent past "more so when government has not entered into any dialogue on this issue”.

While protests over citizenship laws have been going over for last nearly a month, the lockdown of media in Srinagar has been there for over five months. The government has, however, not attempted to reach out to the people. Top political leaders of Kashmir still remain under arrest. The government has also failed to convene meetings and speak to other major political parties on these issues.

It has not reached out to even the state governments and several of them have declared their intention not to implement  recently amended central act in their states. This may lead to constitutional crisis and impact centre-state relationship. It is likely that these issues would be resolved by the Supreme Court but it would have been better if the centre had extended dialogue with these states and various political parties.

The Modi government must give up arrogance of power and start dialogue with various steel holders including political parties, intellectuals, experts in diverse fields and even those protesting.

SUPREME COURT & INJUSTICE
How the judiciary has largely surrendered before the political executive?
09.01.20 - Markandey Katju and Janhvi Prakash
How the judiciary has largely surrendered before the political executive?

Thou art weighed in the balance and found wanting

These words, from the Bible ( Daniel : 5 : 27), were used by Sir Winston Churchill in 1938 to criticise Neville Chamberlain, the then British Prime Minister, for signing the shameful Munich Pact with Hitler, and they can be aptly used for the Indian Supreme Court too for its recent dismal, distressing, disheartening and discomfiting performances in repeatedly failing to protect the fundamental rights of the Indian people, which is its sacred and solemn duty under the Constitution.

The Indian Constitution, promulgated in 1950, had a part (Part 3) containing certain ‘fundamental rights’ of the people. These fundamental rights incorporated the theory of the English political philosopher John Locke in his Second Treatise on Civil Government (written in 1690) that every citizen had certain ‘natural’ rights, which even the King could not violate.

This theory was the basis of the Bill of Rights in the US Constitution, as well as the Declaration of the Rights of Man in 1789 by the French National Assembly during the French Revolution.

Under the Indian Constitution these fundamental rights were rights which even the legislature or executive could not legally violate.

But who was to ensure that they were not violated? This was the job of the judiciary, which was meant to be independent of the legislature or executive.

The Supreme Court and High Courts were set up to act inter alia as guardians of the Constitution and protectors of the fundamental rights of the people, and their judges take a solemn oath to uphold the Constitution, which would include Part 3.

Thus, in State of Maharashtra vs Bhaurao Punjabrao Gawande (2008) 3 SCC 613 the Supreme Court observed that while the first object of the Founding Fathers was to give to the people a Constitution whereby a government was established, their second object, equally important, was to protect the people against the government. The Court observed:

"The imperative necessity to protect the people’s rights is a lesson taught by all history and all human experience. Our Constitution makers had lived through bitter years of the freedom struggle, and had seen an alien government trample upon human rights which the country had fought hard to preserve. They believed, like Jefferson, that ‘ an elective despotism was not the government we fought for ‘. And therefore while arming the government with large powers to prevent anarchy from within and conquest from without, they took care to ensure that these powers were not abused to mutiliate the liberties of the people"
In one of its early decisions, State of Madras vs VG Row, AIR 1952 SC 196 the Supreme Court held "As regards the fundamental rights the Court has been assigned the role of a sentinel in the qui vive", which expression ( ‘sentinel on the qui vive’ )  has been reiterated again and again in several decisions of the Court e.g. I.R.Coelho vs State of Tamilnadu, (2007) 2 SCC 1. Navtej Singh Johar vs Union of India, (2018) 10 SCC 1, Shakti Vahini vs Union of India, (2018) 7 SCC 192, C.Ravichandran Iyer vs Justice AM Bhattacharjee (1995) 5 SCC, Padma vs Hiralal Motilal Desarda (2002) 7 SCC 564, Bachan Singh vs State of Punjab (1982) 3 SCC 24, Indra Sawhney vs Union of India 1992 Supp (3) SCC 217, etc.

In the 13 Judge Constitution Bench decision in Kesavanand Bharati vs State of Kerala, (1973) 4 SC. 225 (408) the Supreme Court observed "The Constitution has entrusted to the judiciary the task of safeguarding the fundamental rights of the people". On page 907 of the same decision the Court observed that the judicature is the guardian of the Constitution, and can check legislative or executive action, and the same view has been taken in National Legal Services Authority vs Union of India, (2014) 5 SCC 438, Raja Ram Pal vs Hon, Speaker (2007) 3 SCC 184 (429), etc.

As held in Navtej Singh Johar ( supra ), once violation of the fundamental rights of a citizen or a group of citizens is brought to the notice of the Court, the Court cannot remain a mute spectator. As held in Shakti Vahini vs Union of India (supra), when there is violation of fundamental rights, the Court cannot choose the path of silence.

As observed by the Supreme Court in C.Ravichandran Iyer vs Justice AM Bhattacharjee (supra)

"Under the Constitution, it is the judiciary which is entrusted with the task of keeping every organ of the state within the limits of the law. The judiciary must protect the citizen against violation of his constitutional or legal rights, and it must stand between the citizen and the state as a bulwark against executive excesses, and misuse or abuse of power by the executive".

In Shakti Vahini vs Union of India (supra) the Court observed, "Once a fundamental right is inherent in a person, intolerant groups cannot scuttle the right by leaning on any kind of philosophy, or self proclaimed elevation"

This being the settled Constitutional position, we may now ask whether the Supreme Court of late has been doing its solemn duty of protecting the rights of the people? It must be regrettably said it has not, rather the impression which has been created by its recent verdicts, orders and actions (including its inactions) is that it has, with some exceptions, largely surrendered before the political executive, instead of behaving like an independent organ of the state which it was expected to be. Consider the following :

1. In the article by one of us (Justice Katju) ‘The Ayodhya verdict is based on a strange feat of logic’ it has been stated that this disgraceful judgment will go down in the annals of Indian legal history in the same category as the shameful ADM Jabalpur vs Shivakant Shukla decision except that unlike the latter, in this one there is not a single courageous dissent.

In substance the Court has held that might is right. It is like a bully snatching a sandwich from a child in school, and the teacher giving a ‘balanced decision’ that the bully can keep the sandwich, and the child will be given a slice of bread as restitution.

2. The Supreme Court Collegium recommended Justice Akil Kureshi of the Bombay High Court to be appointed as Chief Justice of MP High Court. Instead of making the appointment, the Government sent the recommendation back to the Collegium, evidently because Justice Kureshi is a Muslim.

Justice Akil Kureshi
Thereafter the Collegium should have reiterated its recommendation, and then in view of the verdict in the Judges case the Government would have had to make the appointment, But instead, the Collegium disgraced itself by surrendering, and instead recommended his transfer as the C.J. of the much smaller Tripura High Court.

3. The Supreme Court Collegium had recommended the appointment of Gopal Subramaniam, an outstanding Senior Advocate of the Supreme Court, and former Solicitor General of India, as a Judge of the Supreme Court. But the Government objected as he had been a lawyer against BJP leader Amit Shah in the Sohrabuddin case. Instead of reiterating his name, the Supreme Collegium meekly surrendered.

4. After abrogating Article 370 of the Constitution on 5th August there has been a clampdown in Kashmir,  many restrictions imposed e.g. ban on internet, curfews, etc and many political leaders including the 82 year old Dr Farooq Abdullah are still in detention.

Many petitions challenging the violation of the democratic rights of Kashmiris were filed in the Supreme Court, but the Court, like Bheeshma Pitamah who refused to intervene in the ‘cheer haran’ of Draupadi, has turned a Nelson’s eye to the same. What then remains of the lofty doctrine proclaimed in Navtej Singh Johar and Shakti Vahini that when there is violation of fundamental rights the judiciary cannot remain a silent spectator?

5. In the case of the Bhima Koregaon accused and Prof Saibaba the Supreme Court should have quashed the prosecution using the Brandenburg test (relied on in Arup Bhuyan vs State of Assam, and Sri Indra Das vs State of Assam) but it did not even consider the same.

6. Abhijit Iyer Mitra should have clearly been granted bail in view of the decision of the celebrated Justice Krishna Iyer in State of Rajasthan vs Balchand that bail not jail is the normal rule, unless the accused is likely to abscond or tamper with the evidence, or was accused of a heinous crime. Abhijit had only made a satirical tweet, for which too he had promptly apologized. Yet his bail application was rejected, with a flippant and cruel remark by CJI Gogoi that the best place for him was in jail.

7. The brave police officer Sanjiv Bhat (in pic) who gave an affidavit against Modi and his role in the massacre of Muslims in 2002 has been clearly victimised, and he should have been set free, but the Supreme Court refused to do justice in the matter.

8. Recently about 50 masked hooligans beat up students and teachers in JNU with the police apparently complicit, and about 30 persons were admitted to AIIMS, Delhi with serious injuries. The Supreme Court should have suo motu issued notice to the concerned authorities, and taken the guilty to task, but again it turned a Nelson’s eye

9. The UP police brutally beat up the anti CAA protesters, and even entered some houses (probably all Muslims), beat up the inhabitants (including old people) and destroyed or looted property. Again, the Supreme Court took no notice, though this was widely reported in the media.

10. Within 72 hours of his reinstatement by the Supreme Court, the CBI Director Alok Verma was removed by a panel headed by Prime Minister Modi. The Supreme Court should have reinstated him, but did not do so.

11. Ever since the present government came to power there have been continuous attacks and victimization of Muslims e.g, by lynching, hate speeches, etc.

A former Union Minister even garlanded some alleged lynchers, and another Union Minister called them ‘haraamzadas’. Instead of taking strong action against the lynchers, often the family members of the victim are harassed e.g. Akhlaque’s family. Surely it is the duty of the judiciary to grant protection, but it rarely does anything except utter homilies.

12. There is frequent and arbitrary use of sedition and preventive detention laws against those who criticise the government, e.g. cartoonist Aseem Trivedi in Maharashtra, Prof Ambikesh Mahapatra of Jadavpur University in West Bengal, folk singer Kovan in Tamilnadu, and Kashmiri politicians like Farooq Abdullah and others under detention, which make the right to liberty in Article 21, illusory.

Unfortunately, the Supreme Court nowadays rarely interferes in this gross violation of this most precious of all rights (vide Md Sukur vs State of Assam), although in one of its very first decisions, Romesh Thapar vs State of Madras, delivered in 1950 only a few months after the Constitution came into force, it had held that in a democracy people had the right to criticise the government.

In the article ‘Farooq Abdullah detention : the Supreme Court is also on trial’ one of us (Justice Katju) has clearly said that the most important case in India today is not the Ayodhya appeal but the trial of the Supreme Court itself. We are afraid the people’s verdict is likely to go against the court unless it quickly recovers and resumes its role of guardian of the liberties and rights of the people.

Justice Markandey Katju is former Judge, Supreme Court of India and former Chairman, Press Council of India.

POLITICS 2020
Is there a method in this madness?

Is there a method in this madness?

India’s image as a fast growing world power and one of the flag bearers of democracy has taken a serious hit with a series of incidents in the recent past which have shown the country in poor light. The country is hurtling from one crisis to another, thanks to the single minded obsession of the ruling party to thrust it agenda, even as the economy is in a doldrums.

The government has opened a number of fronts at the same time and there appears a pattern of one crisis giving way to another. Whether it is deliberate to divert attention or whether the government is incapable of dealing with the developing situation is a question that is debatable and perhaps we would know the final answer only through historians. Yet there is no doubt that the current phase would go down as a dark chapter in the country’s history.

The second term for the Modi led government began with an increase in the vote share of the Bharatiya Janata Party from 31 per cent in 2014 to 37 per cent in 2019 but with a huge surge in the number of seats in Lok Sabha. The return of the ruling coalition to power appears to have given it an impression that it has been mandated to bring about drastic changes in the country’s constitutional, societal and cultural moorings.

It has failed to realise that the victory was the result of a combination of factors including the stirring up of nationalistic emotions in wake of Uri and Balakote incidents, economy doing better, our international standing on the rise and a poor, weak, fragmented and disappointing opposition led by Rahul Gandhi who proved no match to Modi as prime ministerial candidate.

The BJP should have, however, learnt its lessons with subsequently losing five major state assembly elections and growing disenchantment throughout the country. Rather it is hell bent on pushing through its agenda as if there is no tomorrow. As thinker and writer Partap Bhanu Mehta put it, the government appears determined to "invent enemies” to keep the attention diverted from real issues.

Barely had the government succeeded in keeping a check on law and order situation in the wake of Supreme Court verdict in the contentious Ayodhya case, it went ahead with the drastic step on withdrawal of Article 370 and abrogation of Article 35 providing special status to Jammu and Kashmir.

It’s been over five months but situation has not normalised in the Valley with continued severe restrictions on internet and social messaging. If the situation was under control, as claimed by the government, it should have restored all facilities by now. We surely haven’t heard the last from the Valley yet.

The failure of the exercise in Assam to identify huge number of illegal migrants (presumed to be Muslims) led the government to bring in another contentious law, the Citizenship Amendment Act (CAA) to be followed by National Register of Citizens (NRC) across the country.

The NRC in Assam could identify just 19 lakh illegal migrants among whom the majority - 12 lakhs - were Hindus.

The assertion of the government in and outside the Lok Sabha that the CAA and NRC were linked, kicked up a storm with youths almost across the country protesting the move.

The country had rarely seen such kind of widespread protests in the recent past. The government did try to backtrack a bit with prime minister Narendra Modi contradicting his home minister and saying that the proposal had never been discussed.

Even as protests continued across several states, Amit Shah fuelled more fires with his casual use of phrases like "tukde tukde gangs” and "urban naxals” which propelled andh bhakts to unleash their fury wherever possible.

Then came the blatantly partial and divisive action of the Delhi Police, directly under the control of the union home ministry, while dealing with students from Jamia Milia Islamia and Jawaharlal Nehru University. The images and videos of police chasing and beating up students, and even firing at students, in Jamia campus and then turning a blind eye on goons hitting students and damaging property in JNU, have led to great resentment among the youth across the country and has damaged the country’s democratic credentials across the world.
An unabashedly biased police has even gone further to register cases against the president of the JNU students union despite she being a victim of the attack by goonda elements inside the University campus. The photograph of her blood stained face would continue to haunt public memory for long time to come. World media appears aghast with the developments in the largest democracy and several world leaders have expressed concern.

The government must act with maturity and avoid unnecessary conflicts and should start paying more attention to the other pressing issues like jobs, development, economy and progress of the country.
