Apologize or face trial in defamation case: SC to RaGa



The Supreme Court on Tuesday asked Congress vice-president Rahul Gandhi to express regret for his comments holding the Rashtriya Swayamsevak Sangh (RSS) responsible for Mahatma Gandhi's assassination or be ready to face a defamation trial.

"You can't make wholesale denunciation of an organization."

"If you won't apologize, you will have to face trial," the court said pulling up the Congress leader for his remarks.
 
Mr. Gandhi is alleged to have said that "Gandhiji was shot dead by RSS people and their people talk of Gandhiji”.

Rahul Gandhi's counsel tried to justify his remarks saying these are historical facts and even part of the government records.

The apex court said that Rahul needed to prove what was the public good in his statement against the RSS and hence it was a matter of trial.

The SC said that if Rahul Gandhi wanted to defend himself and was not ready to express his regret, than it will be better that he faced trial.

Mr. Gandhi's comments are alleged to have been made in March 2014 during a parliamentary election rally at Bhiwandi in Thane district of Maharashtra. He was charged with criminal defamation for allegedly referring to the "assassin of Mahatma Gandhi and his RSS background in his election speech”.

The comment had led to a criminal complaint being filed by RSS activist Rajesh Kunte against Mr. Gandhi. Mr. Kunte termed the comment as "false, frivolous, baseless and wanton allegations, imputations against the RSS and its people with malafide motive to harm the reputation of RSS, its followers, people, swayamsevaks".

A bench of Justices Dipak Misra and R F Nariman refused Rahul's request for two-week adjournment and posted the matter for hearing on July 27.

Rahul wanted two-week's time saying his counsel Kapil Sibal is not free before that.

10 CRPF commandos killed in Maoist attack in Bihar, Rajnath assures Bihar govt of help



At least 10 paramilitary commandos were killed and five others wounded in an attack by Maoists in Bihar's Aurangabad district on Monday.

The commandos, who belonged to the elite COBRA battalion of the Central Reserve Police Force, were killed as Maoists triggered an Improvised Explosive Device or IED in a forest area around 170 km from state capital Patna. Officials say wounded soldiers are still stuck at the spot.

PK Thakur, the director-general of state police, said eight paramilitary soldiers were killed immediately and two of the five wounded died later in a hospital.
 
The bodies of three dead insurgents were recovered, he said.

The CRPF personnel were conducting anti-rebel operations in the area over the last two days. The CRPF’s director general will visit Gaya on Tuesday to assess the situation.

Bihar DGP PK Thakur said that there were reports of several IED blasts at the encounter site. Officials said the casualties may rise as some of the personnel of the Commando Battalion for Resolute Action (COBRA) were critically injured in a fierce gun battle, which was still raging.

After the Maoists opened fire first, the CRPF retaliated and killed three Maoists and injured half-a-dozen others. The Maoists, however, succeeded in taking away their injured associates to safe spots.

Maoist rebels, known as India’s biggest internal security threat, operate in 20 states and have thousands of fighters, according to the home ministry.

The Maoists have been fighting for more than three decades in central and eastern India, staging hit-and-run attacks against authorities as they demand a greater share of wealth from the area’s natural resources and more jobs for farmers and the poor.
 
Home Minister Rajnath Singh on Tuesday assured the Bihar government of all possible help to tackle the Maoists in the wake of the killing of 10 CRPF commandos by the rebels in the State.

In a telephonic conversation with Bihar Chief Minister Nitish Kumar, Mr. Singh took stock of the situation arising out of the ambush by the Naxals in Gaya.

The Home Minister directed Director General of CRPF K. Durga Prasad to visit Gaya-Aurangabad to assess the situation.

The Chief Minister briefed the Home Minister of the steps taken to nab those involved in the attack on the team of COBRA commandos of CRPF, sources said.

The Home Minister assured the Chief Minister of all possible help to the state government to deal with the situation arising out of the attack, the sources said.

Navjot Singh Sidhu resigns from Rajya Sabha



Senior Bhartiya Janta Party (BJP) leader and nominated Rajya Sabha MP Navjot Singh Sidhu has reportedly resigned from the parliament on Monday.

Former Indian cricketer was asked to step down and make way for Arun Jaitley to fight from his constituency during the 2014 General Elections.

Recently he was appointed as Rajya Sabha MP. According to sources close to Sidhu, he might be joining Aam Aadmi Party.

Sidhu was MP from Amritsar from 2004 to 2014.

Sidhu’s wife Navjot Kaur, a Parliamentary Secretary in Punjab SAD-BJP govt, may also resign, say sources.

The Sidhu couple has been at loggerheads with chief minister Parkash Singh Badal, and his son and deputy Sukhbir Singh Badal, over alleged government bias against Amritsar which they see as an effort to erode their political standing.

AAP has been campaigning in Punjab for the upcoming assembly elections in 2017.

PDP Legislator Injured After His Vehicle, Attacked By Crowd, Turns Over



Peoples Democratic Party (PDP) legislator Mohammad Khalil Bandh was injured after a crowd allegedly attacked his vehicle when he was on his way to Srinagar.

Police and PDP however denied any mob attack saying Bandh’s vehicle met with a road accident that caused injuries to him.

According to reports, Bandh was on his way to Srinagar from Pulwama late Sunday night when a mob attacked his vehicle with stones.

Such was the intensity of the stone pelting that his vehicle lost balance and skidded off the road before turning turtle.
 
Bandh who received serious wounds had been shifted to the army hospital for treatment.

Superintendent of police, Pulwama, Rayees Mohommad Bhat however told media that the vehicle of the MLA lost balance and suffered an accident. "He has been slightly injured. But there was no mob attack as such”, he said.
 
PDP too said Bandh was injured in a road accident. "I have heard that there was a road accident”, said Waheed-ur-Rehman Para, Youth President of PDP.

In another incident, mob attacked an army hospital in Drugmulla village in border district of Kupwara. "Army Hospital at Drugmulla was targeted by miscreants on July 15. This hospital treats more civilian population than army men. Last year it gave free treatment to more than 10,000 civilians", tweeted Northern Command of the army.

Condemning the incident, the army said targeting medical installations and hospitals is highly reprehensible. "Elders in the society should educate misled youth not to indulge in such acts”, the Northern Command of the army added.

Many politicians of the PDP or People's Democratic Party have faced attacks in the violent protests that have followed the killing of Hizbul Mujahideen terrorist Burhan Wani in a police operation on July 8.

Over 40 have been killed in clashes with security forces and 2,000 have been injured. Over 600 have pellet injuries and may lose their eyesight.

The state government and its supporters have suffered a backlash over the past few days over the killing of 22-year-old Wani, the poster boy of new militancy in Kashmir, represented by young, educated boys from affluent families.

Pema Khandu to be sworn in as next Arunachal CM today



Pema Khandu, who was elected leader of the Congress in the Arunachal Pradesh assembly yesterday, will take oath as Chief Minister today.

Elected leader of the Congress Legislative Party (CLP) in the Arunachal Pradesh assembly on Saturday, Khandu has claimed the support of 44 MLAs including 15 Congress and 29 dissident Congress legislators who had joined the People's Party of Arunachal (PPA) in February as well as two independent legislators in the 60-member assembly.

The name of Pema Khandu, son of late chief minister Dorjee Khandu, was proposed by Tuki who tendered his resignation to Governor Tathagata Roy on Saturday.
Khandu emerged as the new star on the north eastern horizon when he was elected leader of the Congress in Arunachal Pradesh on Saturday, in a dramatic turn of events for the beleaguered party fighting to save its government.

Son of late Chief Minister Dorjee Khandu, who died in a chopper crash in 2011, the 37-year-old graduate from Delhi's prestigious Hindu College had an early entry into governance after his father's demise.

And in five years, he has emerged as the chief ministerial prospect after Supreme Court's intervention that changed the course of politics in the state with dissidents returning to Congress.

Khandu, who hails from Tawang, bordering China, first entered the Arunachal Pradesh assembly in 2011 to fill the vacancy caused by his father's death. His election as MLA from Mukto (ST) constituency was uncontested and he was soon included in the state government as Cabinet Minister for Water Resource Development and Tourism.

He had joined the Congress in early 2000 and became Secretary of Arunachal Pradesh Congress Committee in 2005 and President of Tawang District Congress Committee in 2010. 

Khandu was re-elected unopposed from Mukto in the 2014 assembly elections.

Meanwhile, observers believe the Congress is expected to give Tuki a bigger political role, preferably in Delhi, where they can showcase him as someone who was targeted by the BJP and the Central government and came out unscathed and vindicated.
 
It may be noted here that Tuki had been reinstated as chief minister by the Supreme Court as it quashed the orders of Arunachal Pradesh Governor Jyoti Prasad Rajkhowa who, among other things, had had President's Rule imposed in the state following the defection of several rebel Congress MLAs to the BJP.
