Shashi Tharoor tweets in support of Chidambaram with yet another big word



Congress leader Shashi Tharoor has come in support of his party colleague P Chidambaram. In a tweet posted late Wednesday evening, Tharoor hailed Chidambaram for 'standing up to persecution' and 'character assassination'. And true to his style, he took the opportunity to treat his followers on social media to yet another tongue twister of a word.
 
His tweet, in this instance, referred to a quote by Mr Chidambaram to a newspaper daily last year: "To a person running scared, every shadow will be a demon."

"Well said @PChidambaram_IN!" Shashi Tharoor said in his tweet. "It is a tribute to your strength of character that you are standing up to persecution and character assassination with courage and confidence. I believe justice will prevail in the end. Till then, we will have to allow some malicious minds their schadenfreude." 


The Merriam-Webster dictionary defines schadenfreude, a word of German origin, as "enjoyment derived from the troubles of others".

The former finance minister was arrested Wednesay late evening by the CBI after a drama that lasted for hours. 

The Congress leader came under the scanner after probe agencies accused his son, Karti Chidambaram, of receiving kickbacks in exchange for facilitating an infusion of foreign funds amounting to Rs. 305 crore into INX Media in 2007. Mr Chidambaram was the Finance Minister in the UPA government at the time.

Congress leaders rallied in support of their leader. "Modi's Govt is using the ED, CBI & sections of a spineless media to character assassinate Chidambaram. I strongly condemn this disgraceful misuse of power," Rahul Gandhi said.

"He unhesitatingly speaks truth to power and exposes the failures of this government, but the truth is inconvenient to cowards so he is being shamefully hunted down. We stand by him and will continue to fight for the truth no matter what the consequences are," said Priyanka Gandhi Vadra.

Activists express solidarity with Kashmiris, demand immediate rollback of Modi govt’s moves on Art 370, 35-A



CHANDIGARH: Giving a resounding clarion call to India’s wider citizenry that believes in Constitutional values and democratic principles, a widely attended conclave of region’s activists, intellectuals, academicians, religious and political leaders demanded immediate roll back of Modi government’s move on Article 370, restoration of Art 35 A and statehood status to Jammu and Kashmir, and an end to the regime of atrocities on common populace of the Valley.

The gathering expressed complete solidarity with the Kashmiri people and resolved to send a delegation to the Valley to meet all stakeholders and the  leadership of the Kashmiri people to express solidarity.

The gathering expressed serious concern about the relentless march of unabashed majoritarianism , led from the front by the Amit Shah-Narendra Modi  duo and their brute majority in Parliament that still has the EVM cloud hanging over it. It also made clear its disappointment with the cowardly stances of major political parties in the Opposition on this issue. 

"It signifies the failure of the Indian democracy. While the Kashmiris are being denied even the political avenues for protest, the same could also be the fate of other minorities very soon, or of anyone standing up for constitutional liberties,” various speakers said.

Former Punjab Assembly Speaker Bir Devinder Singh said the people in Kashmir are virtually under house arrest even as the state is flinching in even calling it a curfew. "Activists and pictures from the Valley have called the government's bluff, but vast sections of the media, used to baying for blood and calling it nationalism, is claiming normalcy,” he said.

Giani Kewal Singh, the former jathedar of Takht Damdama Sahib, said the Sikhs have a great historical legacy of fighting against repressive regimes and they will not be found wanting in standing up for their brethren in Kashmir who are today facing the brunt of the Brahamanical state. 

Castigating the BJP for its failure to censure some of its responsible leaders, including a chief minister, for openly coveting the land and women of Kashmir, Prof Manjit Singh said the use of outrageous and despicable language against Kashmiri women and threats to Kashmiri students across India betray the real mindset of those who are claiming to have integrated Kashmir by abrogating Art 370.

"On the one hand, India wants to become a permanent member of the United Nations Security Council, but on the other, it is now forced to explain the repression let loose on Kashmiris and the uninterrupted series of lynchings in the same Security Council,” the gathering said.

"India today stands in breach of faith. The Centre has damaged the compact between Kashmir and the rest of India. The state has been broken into two, and reduced to Union Territories. Humiliation is being peddled as integration,” said senior lawyer Amar Singh Chahal.

"Humongous political decisions regarding Kashmir were taken after arresting or detaining hundreds of top leaders and grass- root workers. Even days later, New Delhi is afraid of allowing the Kashmir people to step out of their homes, thus justifying all the violence that non-State actors indulged in the past,” said Jaspal Singh Sidhu, senior journalist who covered the militancy in Punjab for years.

The Centre’s move has weakened the liberal voices across the turf and may lead to radicalisation in the rest of the country, Gurtej Singh, IAS (Retd), said.

Kanwaljit Singh, a CPI (ML) leader, said when politics is reduced to just raw power and the rulers free themselves of any constraints of law, liberty and morality, then democracy becomes a tragic joke. "It is disappointing to see even the Indian legal system abdicating its responsibility to protect the letter or the spirit of the Constitutional liberties,” said Dr Piare Lal Garg, social activist and former Registrar of Baba Farid University of Health Sciences.

A resolution passed by the gathering said any meaningful politics in Kashmir is now only possible if Article 35-A and Article 370 are restored, political prisoners are released and politics replaces jackboots. 

"The sick cannot access treatment, the children cannot go to school, the youth cannot hang out together, the elderly cannot venture out, the women cannot go about their daily chores, the infants cannot have enough milk, people cannot buy vegetables, the poor and daily wagers cannot find work, the traders cannot open their shops, the girls cannot ride a bicycle to the next street. One can be shot to death for even making any such attempt, and the government says it is all for the benefit of Kashmir. This state of affairs must end immediately,” said Chanchal Manohar Singh, an India Pakistan peace activist.

PUCL National Organising Secretary, Advocate Arjun Sheoran said the Centre's move on Kashmir must be seen in the larger matrix of a plethora of laws, starting with the controversial National Investigation Agency Act, 2019 that gives New Delhi sweeping powers and intrudes into the domain of the states, thus chipping away at federal principles. The UAPA Amendment Bill, the Biotechnology Bill, the Aadhaar Amendment Bill, the Industrial Employment (Standing orders) Central (Amendment) Rules, 2018, the Code on Wages Bill, the Surrogacy (Regulation) Bill, the Citizenship (Amendment) Bill, the Triple Talaq Bill, and several other pieces of legislation that either violate the spirit of federalism, or have been passed without due scrutiny of the Parliamentary bodies. 

Various speakers expressed deep concern at how the state has now inversed the very principle of jurisprudence – it can declare anyone a terrorist, and the onus to prove that one is not a terrorist will be on the person thus declared as Enemy of the State.

It is time the concerned citizenry took note of the majoritarian streak in Indian polity edging out the progressive, liberal view point and threatening minorities, tribals, dalits, women and the marginalised, speakers said.

Among others who spoke were Rajinder Singh Khalsa of Khalsa Panchayat, Dr Kuldeep Puri of Panjab University, Balwant Singh Khera of Socialist Party and Omkar Singh, samajwadi neta from Lucknow.

Top Indian writers launch scathing attack on Modi govt on Art 370 move, exhort people to resist



In a boldly worded joint statement that amounts to scathing criticism of the Narendra Modi government's handling of the Kashmir issue, more than 200 top writers and cultural activists of India said the BJP regime has made "a mockery of democracy," "violated (its) solemn promises" and "clandestinely and coercively" abrogated Article 370 of the Constitution, and also exhorted the citizens to resist what it called the "authoritarian challenge."

"By revoking the special status of Jammu & Kashmir and splitting it up into two union territories, the central government has made a mockery of democracy. It has violated the solemn promises made to the state of Jammu & Kashmir by the Union of India during the accession of the state in 1947," said the statement signed by Magsaysay winners Bezwada Wilson and P Sainath; Padma Bhushan Indian classical dancer Mallika Sarabhai; Jnanpith & Sahitya Akademi awardee and Padma Shri Amitav Ghosh; and the much celebrated poet Arvind Krishna Mehrotra, who has translated more than 200 works from the ancient Prakrit language and Hindi, Bengali and Gujarati; besides more than 200 other well known authors and activists.

"The abrogation of Article 370 of the Constitution and the breakup of the state has been executed unilaterally, clandestinely and coercively. The people — across religious, cultural, ethnic and ideological segments — have not been consulted. Indeed, the unprecedented security and information clampdown in the state since 5th August 2019 is proof of the government’s fear of popular discontent and democratic dissent," the statement said.  

"We, Indians who are writers, artists, media persons and cultural activists, condemn the undemocratic and unconstitutional moves of the government in Jammu & Kashmir. We condemn the government’s division of people and territories from above, subverting the very basis of our constitutional federalism. We condemn the state of siege imposed on the people of a state already suffering for many long years," it added.  

The activists said they "demand that the state of siege in Jammu & Kashmir be lifted, and all basic freedoms — including those of free expression, communication and media freedoms — be restored with immediate effect. We demand the restoration of Article 370, and the restoration of the state of Jammu & Kashmir. We declare our solidarity with the Kashmiri people, and call on all our fellow citizens to resist this authoritarian challenge to the freedom and autonomy of Jammu & Kashmir."

Constitutional propriety apart, the Presidential Order revoking Article 370 is patently illegal as it would defeat the very legal structure of Article 370, which has in fact been laid down by the apex court to be ‘not temporary’, according to Punjab Advocate General Atul Nanda.

Reacting to the revocation of Article 370, Nanda said on Monday that the amendment to clause 3 of Article 370 as per the Presidential Order, called the Constitution (Application to Jammu & Kashmir) Order 2019, had been effectively engineered without following the due process laid down in the Constitution itself.

According to the AG, the unamended Article earlier empowered the President to declare Article 370 as inoperative, but the "recommendation” of the "Constituent Assembly of the State” was necessary. This has now been amended to read "on the recommendation of the Legislative Assembly of the State”, he pointed out, adding that the next step would be to declare Article 370 as inoperative based on such "recommendation”.

However, said Nanda, the catch lies in the fact that the Government of India also simultaneously seeks to declare the J&K as a UT, which may be rendered unnecessary as Clause 2 of the Order states that all the provisions of the Constitution of India shall be applicable to J&K. 

Elaborating further on the legal and Constitutional position, Nanda said the key question here was whether such a sweeping Presidential Order could have been passed at all. Pointing out that the Order is clearly an amendment of Article 370(3), which is a Constitutional provision, he said the first step, ideally, should have been a constitutional amendment of Article 370. And this, he said, should have been done by following the procedure laid down under Article 368, to include the changes now effected through the presidential order. 

Clearly, this would have required the introduction of a separate Bill in each House to be approved by 2/3rd of the majority present and voting, according to Nanda. What is more, given that this also affects the representation of States in Parliament, the consent of half the States in India would also have been needed, he added. In the present circumstances, all these requirements have been bypassed – a clear violation of the Constitutional provisions.

Nanda further cited judicial decisions to corroborate the argument that the Constitution itself had been negated in the process of revoking Article 370. He pointed out that the Supreme Court 2018 ruling in SBI v. Santosh Gupta had decided several issues, including that Article 370 is not a temporary Article, even though so named. Further, it had laid down that the Union has the power to make laws only on those matters not covered by the Instrument of Accession, said the AG. 

Undoubtedly, the old 1962 Supreme Court judgment in Puranlal Lakhanpal v. President of India has held that in exercise of his powers to apply provisions of the Constitution of India, the President may ‘amend’ a Constitutional provision for its application to J&K, according to the AG. However, he observed that it was unclear whether such power of modification could be used to amend Article 370 itself or simply to sweepingly apply the entire Constitution to J&K as has been done. This, he added, would defeat the very legal structure of Article 370. 
 
With reference to Article 35A, Nanda clarified that the same had been essentially scrapped by the Presidential Order, which superseded the earlier Constitution (Application to Jammu and Kashmir) Order 1954. The 1954 Order, defining the constitutional position of the state of Jammu & Kashmir vis-à-vis the Indian Union, had originally added Article 35A, which allowed special privileges to the state’s ‘permanent residents’, as defined by the J&K legislature.

CHANDIGARH, AUGUST 5 - Terming it as totally unconstitutional, Punjab Chief Minister Captain Amarinder Singh on Monday flayed the manner in which the Centre had imposed its decision on Kashmir, saying the democratic fabric of the nation had been ripped apart with this unprecedented violation of the Constitutional norms.

"It is a dark day for the Indian democracy,” said Amarinder, adding that the Constitution of India had been rewritten without following any legal provisions. Such a historic decision should not have been taken and pushed through in this arbitrary manner, he said.

This will set a bad precedent as it would mean that the Centre could reorganise any state in the country by simply imposing President’s rule, the Chief Minister said, adding that the Constitutional provisions had been abused as never before.

None of the stakeholders were taken into confidence, and there was no discussion with other political parties preceding the unilateral decision of the central government, he pointed out. The BJP is using its brute majority to bulldoze democratic and constitutional norms, the chief minister said.

No effort was made to evolve a consensus on this vital matter of national security and concern, said Amarinder, asserting that given the sensitivity of the Kashmir issue, any decision should have been taken after following due process of democratic and legal norms. Even the Presidential order reorganising Jammu and Kashmir and scrapping Article 370 had effectively bypassed the parliamentary requirement for a two-thirds majority through a constitutional amendment, he pointed out.

The government, said the Chief Minister, had made a total mockery of the constitutional and democratic foundations of the nation. Dubbing the Centre’s act of putting political leaders in Kashmir under house arrest ahead of the announcement as despotic, he said the voice of the people had been completely suppressed, which could have serious negative repercussions for India.
